Cancellation and Return Terms
CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS
GENERAL:
By placing an electronic order on the website you are using, you are considered to have accepted the preliminary information form and distance sales contract presented to you.
Buyers are subject to the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchased.
Shipping costs, including any delivery charges, will be borne by the buyers.
DELIVERY OF PURCHASED PRODUCTS:
Each purchased product will be delivered to the person or organization at the address provided by the buyer within 30 days, without exceeding the legal time frame. If the product is not delivered within this period, buyers can terminate the contract.
The purchased product must be delivered complete and in accordance with the specifications stated in the order, along with any warranty certificate, user manual, or other relevant documents, if applicable.
In case the purchased product becomes impossible to sell, the seller must inform the buyer of this situation in writing within 3 days from the moment the seller becomes aware. The full amount must be refunded to the buyer within 14 days.
IF THE PURCHASED PRODUCT IS NOT PAID:
If the buyer does not pay the price of the purchased product or cancels the payment in the bank records, the seller's obligation to deliver the product is terminated.
UNAUTHORIZED USE OF THE CREDIT CARD FOR PURCHASES:
If, after the product is delivered, it is determined that the credit card used by the buyer has been fraudulently used by unauthorized persons, and the payment for the sold product is not made to the seller by the relevant bank or financial institution, the buyer must return the product within 3 days to the seller at the seller’s expense for shipping.
IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:
If unforeseeable force majeure circumstances occur and the product cannot be delivered on time, the buyer will be informed. The buyer may request to cancel the order, replace the product with a similar one, or delay the delivery until the obstacle is removed. If the buyer cancels the order and paid in cash, the payment will be refunded within 14 days. If the payment was made by credit card, the amount will be refunded to the bank within 14 days, but the bank may take 2-3 weeks to process the refund to the buyer’s account.
BUYER’S OBLIGATION TO CHECK THE PRODUCT:
Before accepting delivery of the product/service, the buyer must inspect it; they should not accept any damaged or defective goods, such as products with dents, cracks, or torn packaging. The product/service will be assumed to be undamaged and intact once accepted. After delivery, the buyer must take care of the product/service. If the right of withdrawal is to be used, the product/service should not be used. The invoice must also be returned with the product.
RIGHT OF WITHDRAWAL:
The buyer may exercise the right of withdrawal without any legal or penal responsibility and without providing any reason, within 14 (fourteen) days from the delivery of the product to themselves or the person/organization they designated, by notifying the seller via the contact information below.
RIGHT OF WITHDRAWAL PERIOD:
If the purchased item is a service, the 14-day period begins from the date the contract is signed. Withdrawal cannot be exercised in service contracts where the service has already begun with the buyer's consent before the withdrawal period ends.
Costs resulting from the exercise of the right of withdrawal are the responsibility of the seller.
To exercise the right of withdrawal, the buyer must notify the seller in writing within 14 (fourteen) days via registered mail, fax, or email, and the product must not have been used as stipulated in the “Products for which the Right of Withdrawal Cannot be Used” section of this agreement.
RETURN CONDITIONS:
The seller must refund the total amount and any documents obligating the buyer within 10 days from receiving the withdrawal notification and must return the product within 20 days.
If the value of the product decreases due to the buyer’s fault or if the return becomes impossible, the buyer is obligated to compensate the seller for the damages in proportion to the fault. However, the buyer is not responsible for changes or deterioration caused by proper use of the product during the withdrawal period.
If the total amount falls below the campaign limit due to the use of the right of withdrawal, the discount obtained through the campaign will be canceled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:
Products made according to the buyer's request or clearly tailored to their personal needs, products that cannot be returned due to their nature, perishable items, products that may deteriorate or expire soon, goods that cannot be returned for health or hygiene reasons once the packaging has been opened, and products that, after being delivered, mix with other items and cannot be separated are not subject to the right of withdrawal.
Cosmetic and personal care products must remain unopened, unused, untested, and undamaged for a return to be accepted.
DEFAULT AND LEGAL CONSEQUENCES:
If the buyer defaults on the payment made via credit card, the buyer agrees and commits to pay the related bank the interest stipulated in the credit card agreement. The bank may pursue legal actions, and the buyer may be liable for any costs and attorney fees. If the buyer defaults on the debt, the buyer agrees to compensate the seller for any damages caused by the delay in fulfilling the debt.
